Please read these Terms carefully before using the Site. By accessing or using it, you agree to be bound by them.

1. Acceptance of These Terms

Welcome to MyClay. These Terms of Service ("Terms") govern your access to and use of the website located at https://myclay.online and any related pages, features and services (together, the "Site"), operated by MyClay ("MyClay," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site. If you are using the Site on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf.

2. Definitions

  • "Content" means all text, articles, guides, images, diagrams, infographics, metadata and other materials available on the Site.
  • "You" or "Reader" means any person who accesses or uses the Site.
  • "Third-Party Services" means services operated by others, including advertising, analytics and linked websites.

3. Eligibility

The Site is intended for a general audience. If you are a minor in your jurisdiction (generally under 18), you may use the Site only with the involvement and consent of a parent or guardian. By using the Site you represent that you can form a binding contract and are not barred from doing so under applicable law.

4. Content and Intellectual Property

4.1 MyClay publishes original editorial content about working with clay: articles, guides, diagrams, infographics and reference material. All of it is created by or for us and is protected by copyright and other intellectual property laws.

4.2 The "MyClay" name, logo and site design are our property or licensed to us, and may not be used without permission.

4.3 Subject to these Terms, we grant you a limited, personal, non-commercial licence to access and read the Site, and to print or save individual articles for your own private or classroom use. You may quote briefly from our articles with clear attribution and a link to the original page.

4.4 You may not republish, syndicate, translate or redistribute our articles in whole or in substantial part, or use them to train a commercial model, without our written permission. Where an article cites or quotes a third-party source, that material remains the property of its owner.

5. Acceptable Use

You agree not to:

  • use the Site in violation of any applicable law;
  • use automated tools, bots or scrapers to systematically copy the Site or overload our infrastructure;
  • interfere with, disrupt, or attempt to gain unauthorised access to the Site or its servers;
  • remove or alter any copyright, trademark or proprietary notices on our materials;
  • use the Site to distribute malware or engage in fraudulent or deceptive activity; or
  • misrepresent our content as your own.

6. Practical Guidance and Your Own Safety

6.1 The Site publishes practical guidance about a craft that involves real hazards: kilns reaching well over 1,000 °C, open flame, combustible materials, crystalline silica dust, and glaze and clay materials that include substances you should not inhale or ingest.

6.2 Our guidance is general in nature and cannot account for your equipment, your materials, your workspace or your local regulations. It is not a substitute for the manual for your kiln, the safety data sheet for your materials, or professional advice. You are responsible for working safely and for complying with any rules that apply where you are. See our Disclaimer for more.

6.3 Nothing on the Site should be relied on to determine whether a finished piece is food safe. That depends on your glaze chemistry, your clay body, your firing and your local law.

7. Corrections and Submissions

If you submit a correction, comment, photograph or other material, you represent that you have the right to submit it, and you grant us a non-exclusive, worldwide, royalty-free licence to use, display and adapt it on the Site. We may review, decline, edit or remove submissions at our discretion. We welcome corrections and act on them.

8. Third-Party Links

The Site links to Third-Party Services and external sources, including the references cited in our articles and suppliers we mention. We do not control and are not responsible for the content, policies or practices of any third-party site. Links do not imply endorsement, and we receive no payment for the suppliers or products we name unless expressly disclosed on the page.

9. Advertising and Google AdSense

9.1 The Site is supported by advertising, including Google AdSense. Third-party vendors, including Google, use cookies to serve ads based on your prior visits to this Site and other websites.

9.2 You may opt out of personalised advertising by visiting Google's Ads Settings at https://myadcenter.google.com, or opt out of a third-party vendor's use of cookies for personalised advertising via https://optout.aboutads.info. For readers in the European Economic Area, the United Kingdom and Switzerland, we use a Google-certified consent management platform to obtain consent before advertising and other non-essential cookies are set, as required by Google's EU user consent policy. Declining means you see non-personalised ads rather than none.

10.4 Your choices. You can control cookies through your browser settings and through the "Cookie Settings" control on the Site, which lets you change or withdraw consent at any time. Readers in the EEA, the UK and Switzerland have rights under the GDPR and UK GDPR — access, rectification, erasure, restriction, portability, objection and withdrawal of consent — and California and other US state residents have rights including opting out of the sale or sharing of personal information. THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure or error-free, or that any Content is accurate or complete. Nothing on the Site is legal, medical or professional advice.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYCLAY AND ITS OWNERS, OPERATORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, OR FOR ANY INJURY OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100.00). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless MyClay and its owners and operators from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any law or third-party right.

14. Copyright Complaints and DMCA

We respect intellectual property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act. 15. Governing Law and Disputes

15.1 These Terms are governed by the laws of the United States and, to the extent applicable, the jurisdiction in which the operator of MyClay is established, without regard to conflict-of-law principles.

15.2 You agree that any dispute arising out of or relating to these Terms or the Site will be resolved in the courts having competent jurisdiction over the operator of MyClay, and you consent to the jurisdiction of those courts, except where prohibited by applicable law.

16. International Users

The Site is controlled and operated from the United States, and information is processed there; see Section 9 of our Privacy Policy for the safeguards that apply to international transfers. We make no representation that the Site or its Content is appropriate or lawful in other locations. If you access the Site from elsewhere, you do so on your own initiative and are responsible for compliance with local laws, including any regulations covering kilns, workshops and materials handling where you live.

17. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

18. Termination

We may suspend or terminate access to the Site, in whole or in part, at any time and for any reason, including violation of these Terms. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) will survive termination.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and MyClay regarding the Site.
