Our Commitment to Copyright

MyClay (accessible at https://myclay.online) publishes original editorial content about working with clay — articles, guides, diagrams and infographics created by or for us. We respect the intellectual property rights of others, and we expect our readers to do the same.

We write our own material and produce our own images. Where we quote or reference someone else's work, we do so briefly, with attribution and a link, in the belief that this constitutes fair use. We also cite external sources at the end of our articles; those sources remain the property of their owners and we claim no rights in them.

If you are a copyright owner (or an agent acting on their behalf) and you believe material on MyClay infringes your copyright, this page explains how to notify us so we can review it and, where appropriate, remove it. We respond to clear and complete notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

How to File a Copyright (DMCA) Takedown Notice

If you believe your copyrighted work has been copied and made available on MyClay in a way that constitutes copyright infringement, please send a written notice to our Designated Copyright Agent. To be effective under the DMCA, your notice must include substantially all of the following (17 U.S.C. § 512(c)(3)):

  1. Your signature. A physical or electronic signature of the copyright owner, or a person authorised to act on the owner's behalf.
  2. Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed. If multiple works are involved, you may provide a representative list.
  3. Identification of the infringing material. A description of the material you claim is infringing, together with information reasonably sufficient to let us locate it — ideally the exact URL or URLs of the page or pages in question.
  4. Your contact information. Your name, mailing address, telephone number and email address.
  5. A good-faith statement. A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement of accuracy and authority, under penalty of perjury. A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or are authorised to act on the owner's behalf.

Before you send a formal notice: if you simply want to raise a concern or ask a question — for example, if you think one of our diagrams resembles yours, or that a quotation goes beyond fair use — you are welcome to email us first at contact@myclay.online. We take these messages seriously and can usually resolve matters quickly and informally. Please also consider whether the use may be permitted by law before filing, since knowingly materially misrepresenting that material is infringing can expose you to liability under 17 U.S.C. § 512(f), including damages and legal fees.

What We Do When We Receive a Valid Notice

Upon receiving a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the material identified. Where appropriate, we will make a good-faith effort to notify the person who provided the material, so that they may submit a counter-notification. We keep a record of the notices we receive.

Because nearly all content on MyClay is written and produced by us rather than uploaded by third parties, in most cases we will simply review the claim ourselves and remove or amend the material if there is legitimate doubt.

Counter-Notification

If you submitted content that was removed or disabled as a result of a DMCA notice, and you believe the removal was a mistake or misidentification, you may send us a counter-notification. To be effective under 17 U.S.C. § 512(g)(3), it must include substantially the following:

  1. Your signature — physical or electronic.
  2. Identification of the removed material and the location (URL) at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your contact information — name, address and telephone number.
  5. A consent-to-jurisdiction statement — that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which MyClay may be found), and that you will accept service of process from the person who filed the original notice or their agent.

Send counter-notifications to the same Designated Agent above. If we receive a valid counter-notification, we may restore the removed material no sooner than 10, and no later than 14, business days after receipt, unless our agent first receives notice that the original complainant has filed a court action seeking to restrain the allegedly infringing activity.

Repeat-Infringer Policy

In accordance with 17 U.S.C. § 512(i), MyClay has adopted a policy of terminating, in appropriate circumstances, the access of anyone found to be a repeat infringer of copyright. We may also remove any material and restrict access at our discretion, with or without notice.

If Someone Is Copying Our Work

The articles, diagrams and infographics on this Site are ours, and they are regularly republished elsewhere without permission. Brief quotation with clear attribution and a link back is welcome and encouraged. Wholesale republication is not, and we do file notices. See our Terms of Service for what is and is not permitted.

Trademark and Other Concerns

This policy addresses copyright. If you have a concern about a trademark, privacy or other non-copyright matter, please contact us at contact@myclay.online and describe your concern.

Changes to This Policy

We may update this DMCA and Copyright Policy from time to time. When we make material changes, we will post the revised policy on this page and update the "Last updated" date above.
